  1. Introduction

At GIGUP LLC, GIGUP LLC’s core mission is to provide empowerment and ease to the candidate and employer hiring process through unique job-matching technologies as well as providing a hybrid job board and social media platform. One of GIGUP LLC’s beliefs is that employers will retain candidates for longer periods of time while offering candidates a proper work-life balance and agreeable wages

This section determines which GIGUP LLC entity acts as the controller, collector, or processor of the Candidate’s (the “Candidate”) Personal Data.

 – GIGUP LLC as Controller.

For the purposes of this privacy policy (the “Privacy Policy”), “GIGUP LLC”, “we” or “us” means: GIGUP LLC.

This Privacy Policy describes GIGUP LLC’s policies and procedures on the collection, use and disclosure of a Candidate’s information when the Candidate uses the Service.

GIGUP LLC offers certain hiring services to Employers where GIGUP LLC acts as a data processor, collector, or similarly, under applicable data protection laws, and processes the personal data it collects from and about Candidates for purposes of employment by Employers. This is a reference to GIGUP LLC’s Candidate Matching System where GIGUP LLC curates Candidates based on distance (mi.), designated time availability, Candidate industry selections, and other types of data collected during Application (the “Application”) usage as well as user’s Account (the “Account”) creation (hereinafter referred to as, the “Candidate Matching System”).

We use Candidate’s Personal Data to provide and improve the GIGUP LLC Service and user experience. By using the Service, Candidates AGREE to the collection and use of information in accordance with this Privacy Policy.

  1. Interpretation and Definitions

2.1 Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

2.2 Definitions

For the purposes of this Privacy Policy:

 

  • Account” means a unique account created by Candidate to access GIGUP LLC’s Service or other parts of GIGUP LLC’s Services.
  • Application” means a portion of the software program provided by GIGUP LLC downloaded by Candidate on any electronic device, named GIGUP LLC.

 

  • “Boost” means a positive, user-generated response including a short recommendation based on previous experiences.

 

  • Candidate” means the potential employee accessing or using the Service, or GIGUP LLC, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable. 

 

  • Candidate Matching System” shall have the meaning set forth herein.

 

  • GIGUP LLC” (referred to as either “GIGUP LLC,” “We,” “Us,” or “GIGUP LLC’s” in this Agreement) refers to GIGUP LLC.

 

  • Country” refers to United States of America.

 

  • Cookies” are small files that are placed on Candidate’s computer, mobile device or any other device by a website, containing the details of Candidate’s browsing history on that website among its many uses.

 

  • Device” means any device that can access the Service such as a computer, a cell phone or a digital tablet.

 

  • “Employer” refers to hiring managers and/or companies who utilize GIGUP LLC to be matched with and potentially hire Candidates.

 

  • “Non-Personal Data” refers to any information that does not identify a specific individual.

 

  • Personal Data” is any information that relates to an identified or identifiable individual.

 

  • Privacy Policy” shall have the meaning set forth in the Introduction.

 

  • Service” refers to any of the individual services, Applications, or promotions managed, maintained, or related to GIGUP LLC.

 

  • Service Provider” means any natural or legal person who processes the data on behalf of GIGUP LLC. It shall also refer to third-party companies or individuals employed or contacted by GIGUP LLC to facilitate the Service, to provide the Service on behalf of GIGUP LLC, to perform services related to the Service, or to assist GIGUP LLC in analyzing how the Service is used. 

 

  • Usage Data” refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Important Note

GIGUP LLC will adhere to the industry standard definitions in determination of what is and is not Personal Data for the purposes of this Privacy Policy. Where this Privacy Policy refers to “information” or “Candidate’s information” this may include both Personal and Non-Personal Data.

  1. Changes to GIGUP LLC’s Privacy Policy

GIGUP LLC reserves the right to modify GIGUP LLC’s Privacy Policy. When updating GIGUP LLC’s Privacy Policy, GIGUP LLC will notify Candidates of any changes with the new Privacy Policy through push notifications, email, or potential third-party services, which will be utilized to help Candidates view the Privacy Policy easier and as updates are released.

We notify Candidates know via email and/or a prominent notice on website or GIGUP LLC’s Service, prior to the change becoming effective and update the “last updated” date at the top of this Privacy Policy.

Candidates are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

  1. Collecting and Using Candidate’s Personal Data

4.1 Types of Data Collected

Personal Data

While using GIGUP LLC’s Service, We may ask Candidates to provide Us with certain personally identifiable information that can be used to contact or identify Candidates. Personally identifiable information may include, but is not limited to:

 

  • Email address: including but not limited to a hashed email address
  • First name and last name: such as first or last name
    • Phone number: including but not limited to a hashed phone number
  • Address, State, Province, ZIP/Postal code, City: such as home address, physical address, or mailing address
  • Usage Data: see section “Usage Data” below

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as the Candidate’s Device’s Internet protocol address (e.g. IP address), browser type, browser version, the pages of GIGUP LLC’s Service that Candidate visit, the time and date of Candidate’s visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When Candidates access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device Candidates use, Candidate’s mobile device unique ID, the IP address of Candidate’s mobile device, Candidate’s mobile operating system, the type of mobile Internet browser Candidates use, unique device identifiers and other diagnostic data.

We may also collect information that the Candidate’s browser sends whenever Candidates visit GIGUP LLC’s Service or when Candidates access the Service by or through a mobile device.

Information Collected while Using the Application

While using GIGUP LLC’s Application, in order to provide features of GIGUP LLC’s Application, We may collect the following information from the Candidate, and Candidate hereby grants consent on information collection:

 

  • Information regarding Candidate’s location

    We use this information to provide Candidate Matching features of GIGUP LLC’s Service to Employers and Candidates. This information is also utilized to improve and customize GIGUP LLC’s Service. The information may be uploaded to GIGUP LLC’s servers and/or a Service Provider’s server or it may be simply stored on Candidate’s device. 

Candidates can enable or disable access to this information at any time through Candidate’s Device settings in the Application or by contacting GIGUP LLC’s support team.

  1. Use of Candidate’s Personal Data

5.1 Potential GIGUP LLC Usage for Personal Data

GIGUP LLC may use Personal Data for the following purposes:

 

  • To provide and maintain GIGUP LLC’s Service, including to monitor the usage of GIGUP LLC’s Service.
  • To manage Candidate’s Account: to manage Candidate’s registration as a user of the Service. The Personal Data Candidate provide can give Candidate access to different functionalities of the Service that are currently available and future updates to Candidate as a registered user.
  • For the performance of a contract: the development, compliance, labor, and completion of the purchase contract for the products, items or services Candidate have purchased or of any other contract with Us through the Service.
  • To contact Candidate: To contact Candidate by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile Application’s push notifications regarding updates or informative communications related to the functionalities, products, promotions or contracted services, including the security updates, when necessary or reasonable for their implementation.
  • To provide Candidate with new services and upcoming promotions: GIGUP LLC’s special offers and general information about other goods, services and events which we offer that are similar to those that Candidate have already purchased or enquired into. Candidate can choose to be opted out to not receive such information.
  • To manage Candidate’s requests: To attend, manage, and complete Candidate’s informational, technological, or other GIGUP LLC related requests to Us.
  • For business transfers: We may use Candidate’s information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of GIGUP LLC’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about GIGUP LLC’s Service users is among the assets transferred.
  • Other purposes of use: We may use Candidate’s information for other purposes, such as data analysis and identifying usage trends. Information can be used in determining the effectiveness of GIGUP LLC’s promotional campaigns as well as evaluating and improving GIGUP LLC’s Service, products, other services, marketing and Candidate’s experience.

5.2 Potential Sharing of Personal Information

We may share Candidate’s personal information in the following situations:

 

  • With Employers: who have entered into agreements with GIGUP LLC.
  • With Service Providers: We may share Candidate’s personal information with Service Providers to monitor and analyze the use of GIGUP LLC’s Service, for payment processing, to contact Candidate.
  • For business transfers: We may share or transfer Candidate’s personal information in connection with, or during negotiations of, any merger, sale of GIGUP LLC assets, financing, or acquisition of all or a portion of GIGUP LLC’s business to another GIGUP LLC.
  • With Affiliates: We may share Candidate’s information with GIGUP LLC’s affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include GIGUP LLC’s parent GIGUP LLC and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
  • With business partners: We may share Candidate’s information with GIGUP LLC’s business partners to offer Candidate certain products, services or promotions.
  • With other users: when Candidate share personal information or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
  • With Candidate’s consent: We may disclose Candidate’s personal information for any other purpose with Candidate’s consent.
  1. Retention of Candidate’s Personal Data

GIGUP LLC will retain Candidate’s Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Candidate’s Personal Data to the extent necessary to comply with GIGUP LLC’s legal obligations (for example, if we are required to retain Candidate’s data to comply with applicable laws), resolve disputes, and enforce GIGUP LLC’s legal agreements and policies.

GIGUP LLC will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of GIGUP LLC’s Service. In some cases, We are legally obligated to retain this data for longer time periods.

  1. Transfer of Candidate’s Personal Data

Candidate’s information, including Personal Data, is processed at GIGUP LLC’s operating offices and in any other places where the parties involved in the processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Candidate’s state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Candidate’s jurisdiction.

Candidate’s consent to this Privacy Policy followed by Candidate’s submission of such information represents Candidate’s agreement to that transfer.

GIGUP LLC will take all steps reasonably necessary to ensure that Candidate’s data is treated securely and in accordance with this Privacy Policy and no transfer of Candidate’s Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Candidate’s data and other personal information.

  1. Disclosure of Candidate’s Personal Data

8.1 Business Transactions

If GIGUP LLC is involved in a merger, acquisition or asset sale, Candidate’s Personal Data may be transferred. We will provide notice before Candidate’s Personal Data is transferred and becomes subject to a different Privacy Policy.

8.2 Law enforcement

Under certain circumstances, GIGUP LLC may be required to disclose Candidate’s Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a cGIGUP LLC’st or a government agency).

8.3 Other legal requirements

GIGUP LLC may disclose Candidate’s Personal Data in the good faith belief that such action is necessary to:

 

  • Comply with a legal obligation
  • Protect and defend the rights or property of GIGUP LLC
  • Prevent or investigate possible wrongdoing in connection with the Service
  • Protect the personal safety of Users of the Service or the public
  • Protect against legal liability

8.4 Disclaimer

GIGUP LLC will not be an employer in this arrangement. We shall also not be responsible for any disputes between candidate and employer. Candidate WAIVES any claim he/she might have arising out of the employment arrangement between Employer and Candidate.

8.5 Disputes

Choice of Law

In the event of a dispute between parties, laws of the state of West Virginia shall apply. 

SITUS

The site for any litigation between involved parties arising out of this Privacy Policy should be exclusively handled in Monongalia County located in Morgantown, WV, USA.

Arbitration

In any event of dispute from any parties involved, it shall be exclusively decided by Arbitration.

  1. Security of Candidate’s Personal Data

The security of Candidate’s Personal Data is important to Us, but GIGUP LLC notes that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use industry standard technologies and services to protect Candidate’s Personal Data, We cannot guarantee its absolute security.

  1. Detailed Information on the Processing of Candidate’s Personal Data

The Service Providers We use may have access to Candidate’s Personal Data. These third-party vendors collect, store, use, process and transfer information about Candidate’s activity on GIGUP LLC’s Service in accordance with their Privacy Policies.

Analytics

We may use third-party Service providers to monitor and analyze the use of GIGUP LLC’s Service.

Email Marketing

We may use Candidate’s Personal Data to contact Candidates with newsletters, marketing or promotional materials and other information that may be of interest to Candidates. Candidates may opt-out of receiving any, or all, of these communications from Us by following the unsubscribe link or instructions provided in any email We send or by contacting Us.

  1. Boosts

Boosts mean a positive, user-generated response including a short recommendation based on previous work experiences. There are 3 initial Boosts available. Boosts will be redistributed to Candidate’s Account after internal processes permit Candidate’s additional Boosts. This is considered a strategic option for Candidates to gain more attention from Employers as being more recommended than other available Candidates.

In the instance of a negative interaction through a Boost, Candidates can have a Boost removed from their page by GIGUP LLC. Please see Section 13 of this Privacy Policy to contact Us.

  1. Children’s Privacy

Our Service does not address anyone under the age of 16. GIGUP’s registration field for date of birth only allows an individual of 16 years or older to register for GIGUP LLC’s services. There is also a checkbox acknowledging that Candidate is under 18 years of age. By selecting the checkbox, Candidates AGREE that they are under 18 years of age and Candidate’s legal guardian granted permission to use the application for all purposes and services. 

In the case that Candidate was signed up and clicked checkbox without parental consent, please see section 14 to contact us for account deletion. All collected information from Candidates under 18 years of age will be stored and utilized exactly the same as a Candidate 18 years of age or older would be handled.

  1. Links to Other Websites

GIGUP LLC’s Service may contain links to other websites that are not operated by Us. If Candidates click on a third-party link, Candidates will be directed to that third party’s site. We strongly advise Candidates to review the Privacy Policy of every site Candidates visit.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.
